B2B Returns and Refund Policy

Due Toscani – www.duetoscani-cashmere.com

Last updated: October 25, 2026

1. Scope of Application

This Returns and Refund Policy applies exclusively to purchases made through www.duetoscani-cashmere.com by businesses, retailers, professionals, and other economic operators acting in the course of their business or professional activities.

These provisions do not apply to purchases made by private consumers, which are governed by separate terms and conditions.

2. Exclusion of the Right of Withdrawal for Change of Mind

Purchases made within the framework of B2B commercial transactions are not subject to the 14-day right of withdrawal provided to consumers under Article 52 of the Italian Consumer Code.

Therefore, Due Toscani does not automatically accept requests for returns or refunds for reasons such as:

  • A change of mind after purchase.

  • Incorrect selection of product model, color, size, or quantity by the Customer.

  • Failure to sell the products through the Customer's physical or online store.

  • Changes in the Customer's business requirements.

  • Subjective preferences concerning product characteristics that comply with the product description.

Customers are encouraged to carefully review the information provided on product pages before confirming their orders.

3. Exceptional Commercial Returns

Due Toscani may, at its sole discretion, consider requests for commercial returns that are not related to product defects or breaches of contract.

Any such acceptance must be expressly confirmed in writing.

Without such authorization, no contractual right to return products due to a change of mind is granted.

Where a voluntary commercial return is authorized, products must be intact, unused, unwashed, unaltered, and complete with all labels originally supplied.

Return shipping costs shall be borne by the Customer unless otherwise agreed.

The conditions of any refund or commercial credit shall be specified in the written authorization.

4. Defective Products and Statutory B2B Warranty

Due Toscani shall be liable for product defects in accordance with Articles 1490 et seq. of the Italian Civil Code, without prejudice to any applicable special or international legislation.

The warranty covers defects that render a product unsuitable for its intended use or significantly reduce its value, under the conditions established by law.

Customers are entitled to the remedies provided under applicable legislation, including, where the relevant legal requirements are met, a price reduction or termination of the sales contract.

Due Toscani may also propose a replacement or another solution mutually agreed upon with the Customer.

5. Deadlines for Reporting Defects

Pursuant to Article 1495 of the Italian Civil Code, Customers must report any defects within eight days of discovering them, unless a different period is provided by law or validly agreed upon.

Notification is not required where the Seller has acknowledged the existence of the defect or has concealed it.

Warranty claims are generally subject to a limitation period of one year from delivery, without prejudice to the exceptions provided under applicable legislation.

Customers are encouraged to inspect products promptly upon delivery and report any problems without delay.

6. Incorrect Products or Quantity Discrepancies

If the Customer receives products different from those ordered or identifies discrepancies in the quantities delivered, they must promptly contact Due Toscani.

The report should include the order number, a description of the discrepancy, and, where possible, photographs of the goods received.

Due Toscani will review the report and, where an error attributable to the Seller is confirmed, arrange with the Customer for delivery of the correct products, completion of the order, a refund, or another remedy provided by law.

Rights arising from incorrect delivery remain governed by the legal provisions applicable to the specific circumstances.

7. Damage During Transportation

Upon delivery, Customers are encouraged to check the condition of the packaging and the number of packages received.

If visible damage is detected, Customers are advised to:

  • Accept delivery with a specific written reservation, where possible.

  • Photograph the packaging before opening it.

  • Retain the original packaging and protective materials.

  • Report the issue promptly to Due Toscani.

Claims relating to transportation damage will be assessed in light of the circumstances, shipping arrangements, and applicable provisions governing the transfer of risk.

Failure to note a reservation upon delivery does not automatically result in the loss of statutory rights.

8. How to Submit a Return Request or Complaint

To submit a request, Customers must contact:

federico@duetoscani.com

The request must include:

  1. Order number and date.

  2. Name of the purchasing company.

  3. Product code or description.

  4. Quantity of items concerned.

  5. Detailed description of the issue.

  6. Photographs documenting the reported problem.

Due Toscani may request additional information or the return of the product to carry out the necessary inspections.

Customers are advised to wait for shipping instructions before returning any goods.

This administrative procedure does not restrict any rights granted under applicable law.

9. Inspection and Handling of Complaints

Each complaint will be assessed according to the nature of the product, its declared characteristics, the available documentation, and the specific circumstances.

Where physical inspection of the product is necessary, Due Toscani will provide instructions for returning the goods.

If a defect attributable to the Seller is confirmed, the Customer shall be entitled to the remedies provided by applicable law or an alternative solution mutually agreed upon.

Refunds are not automatically granted for issues arising exclusively from improper use, incorrect washing, unsuitable treatments, or modifications made after delivery.

10. Natural Characteristics of Textile Products

Products made from virgin cashmere, recycled cashmere, merino wool, and other natural fibers may exhibit characteristics inherent to the raw materials and manufacturing processes.

Slight variations in color shade, hand feel, surface texture, and dimensions may occur within normal manufacturing tolerances and agreed specifications.

Pilling may be a natural characteristic of certain yarns and does not automatically constitute a manufacturing defect.

All complaints will nevertheless be assessed individually, distinguishing natural material characteristics from actual defects.

11. Modified or Relabeled Products

Customers may independently attach their own commercial brand labels to purchased products, in compliance with applicable legislation.

Due Toscani shall not be liable for damage caused by subsequent alterations carried out by the Customer or third parties, including improper label attachment, embroidery, tailoring alterations, or unsuitable treatments.

However, such alterations do not automatically invalidate the Customer's rights regarding original defects unrelated to those modifications.

12. Return Shipping Costs

For authorized voluntary commercial returns, return shipping costs shall be borne by the Customer unless otherwise agreed in writing.

For complaints concerning defects or breaches of contract attributable to Due Toscani, shipping costs and any applicable reimbursements shall be determined in accordance with the obligations established by applicable law.

Practical shipping arrangements shall be agreed upon with Customer Service.

13. Refund Methods

Where a Customer is entitled to a refund, Due Toscani will reimburse the amount due using, where possible, the same payment method used for the original purchase.

Alternatively, a different refund method may be mutually agreed upon.

The refund amount and processing timeframe shall be determined according to the nature of the complaint and applicable legal provisions.

Credit notes will be issued where required by tax legislation.

14. Purchases Intended for Resale

Business Customers assume the commercial risk associated with the subsequent resale of purchased products.

Failure to resell products, reduced demand, or changes in the preferences of their own buyers do not constitute grounds for requesting a return or refund from Due Toscani.

This provision does not limit any rights available to Customers in cases of defects or breaches of contract attributable to the Seller.

15. Orders Shipped Directly to Third Parties

Where a B2B Customer requests delivery directly to their end buyer, the contractual relationship with Due Toscani remains exclusively B2B.

The business Customer remains responsible for managing the relationship with their own buyer, including any applicable withdrawal rights and statutory warranties arising from consumer sales.

Any complaints relating to products supplied by Due Toscani must be submitted by the business Customer in accordance with this Policy.

All mandatory rights and obligations established by law remain unaffected.

16. Governing Law

This Returns and Refund Policy shall be governed by Italian law, without prejudice to any applicable mandatory provisions or international conventions.

For matters not expressly covered by this Policy, the B2B General Terms and Conditions of Sale and applicable legislation shall apply.
